Non so se avete letto qualcosa sulla vicenda del marchio Cohiba.
Vorrei evitare troppi tecnicismi sulla faccenda, sono cose che ci interessano il giusto.
Diciamo che Cuba ha vinto una battaglia legale sul marchio dei sigari Cohiba, un giudice federale degli Stati Uniti si e' pronunciato a favore dell'isola.
Ora e' possibile che si vada in appello, temo qualche intervento dall'"alto", vedremo.

E' una battaglia che dura da quasi 30 anni, il verdetto si riferisce ad una causa intentata nel 2023 da General Cigar Company (Usa) contro Cubatabaco.
La General che vende versioni del famoso marchio negli Usa ha perso ed ora vedremo quali conseguenze ci saranno.
Secondo il giudice il Cohiba di Cubatabaco era protetto da una convenzione interamericana di giustizia, una legge del 1929 che tutela proprio i marchi internazionali.

Tenete conto che UFFICIALMENTE, a causa del bloqueo quei sigari prodotti a Cuba e considerati fra i migliori al mondo non sono legalmente disponibili per la vendita nel territorio americano.
Dico ufficialmente perche' poi...si trovano.
Il realta' il marchio americano commercializza una sorta di "tarocco" che Cuba contesta fin dal gennaio del 1997.

Cubatabaco ottenne la registrazione del marchio nel 1972, 6 anni dopo General Cigar presento' una richiesta simile all'ufficio brevetti e marchi degli Stati Uniti, che fu emessa nel febbraio 1981.
Nella sentenza si legge;" Poiche' la General Cigar era a conoscenza dell'uso del termine Cohiba da parte di Cubatabaco la corte ritiene che il TTAB (non so cosa sia...) abbia validamenta annullato la registrazione della General Cigar ai sensi della sezione 8 dell'IAC.
Cohiba creato nel 1966 e' stato il primo marchio di sigari nato dopo il Trionfo della Rivoluzione, il suo nome richiama uno strumento utilizzato degli aborigeni dell'isola per accendere le foglie di tabacco.

Non sono un fumatore, in realta' in vita mia un paio di sigari cubani li ho fumati, devo dire senza piaceri particolari, ma sono io che non li so apprezzare sicuramente.
Un paio di miei amici Villans ne vanno matti, ad ogni ritorno da un viaggio una scatola per uno di Cohiba non gliela faccio mai mancare, al prezzo che li acquisto io, con gli amici veri non si fa negocio.

Confessandovi una delle tante illegalita' che commettiamo in suolo cubano vi dico che li acquisto da un vecchio bandito tunero che conosco da oltre 20 anni, riesce a farmi avere quelli di fabbrica, non chiedo e non chiedetemi come, i miei amici mi dicono che sono uno spettacolo.
Bisogna stare un po' all'occhio perche' por la calle vendono delle porcherie dentro scatole Cohiba, anche in questo caso occorre avere buoni legami e ottime conoscenze, come del resto per molte altre cose a Cuba.

I don't know if you've read anything about the Cohiba brand story.
I'd like to avoid getting too technical about the matter, these are things that interest us just enough.
Let's say that Cuba won a legal battle over the Cohiba cigar brand, a US federal judge ruled in favor of the island.
Now it's possible that they'll go to appeal, I fear some intervention from "above", we'll see.

It's a battle that's been going on for almost 30 years, the verdict refers to a lawsuit filed in 2023 by General Cigar Company (USA) against Cubatabaco.
General, which sells versions of the famous brand in the US, lost and now we'll see what the consequences will be.
According to the judge, Cubatabaco's Cohiba was protected by an Inter-American Convention of Justice, a 1929 law that protects international brands.

Keep in mind that OFFICIALLY, due to the blockade, those cigars produced in Cuba and considered among the best in the world are not legally available for sale in the United States.
I say officially because then...you can find them.
In reality, the American brand is selling a sort of "fake" that Cuba has been contesting since January 1997.

Cubatabaco obtained the trademark registration in 1972, 6 years later General Cigar filed a similar request with the United States Patent and Trademark Office, which was issued in February 1981.
The ruling reads; "Since General Cigar was aware of Cubatabaco's use of the term Cohiba, the court believes that the TTAB (I don't know what that is...) has validly annulled General Cigar's registration under Section 8 of the IAC.
Cohiba, created in 1966, was the first cigar brand born after the Triumph of the Revolution, its name recalls a tool used by the island's aborigines to light tobacco leaves.

I am not a smoker, in fact I have smoked a couple of Cuban cigars in my life, I must say without any particular pleasure, but I am the one who I certainly don't know how to appreciate them.
A couple of my Villans friends are crazy about them, every time I come back from a trip I never let them go without a box of Cohiba, at the price I buy them, with real friends there is no bargaining.

Confessing to you one of the many illegalities that we commit on Cuban soil I tell you that I buy them from an old bandit tunero that I have known for over 20 years, he manages to get me the factory ones, I don't ask and don't ask me how, my friends tell me that they are a spectacle.
You have to be a bit careful because on the street they sell rubbish in Cohiba boxes, even in this case you need to have good connections and excellent acquaintances, as with many other things in Cuba.
